These Terms govern your use of Gem TD ("the Game"), operated by Jose Yebenes, an individual based in Spain ("the operator", "we", "us"). By playing the Game or creating an account, you agree to these Terms. If you do not agree, please do not use the Game. Contact: [email protected].

1. Eligibility

You must be at least 13 years old to create an account or use cloud features (leaderboards, sign-in, rankings). By creating an account you confirm that you meet this requirement.

2. Your account

• Cloud features start with an anonymous device account, which you can optionally link to Google or Discord.
• You are responsible for activity that happens under your account.
• You agree not to share, sell, or transfer your account, or to create accounts to evade restrictions.

3. Fair play

The leaderboards only mean something if they are honest. You agree not to:

• cheat, tamper with the Game, or submit scores you did not legitimately earn;
• use bots, scripts, or automation to play or to manipulate rankings;
• exploit bugs to gain an unfair advantage, or interfere with other players' experience;
• attempt to probe, scan, or breach the Game's security or infrastructure.

We may remove scores, reset ratings, or suspend or terminate accounts that violate fair play, acting reasonably and proportionately. Rankings and statistics are provided on an "as is" basis and may be adjusted or recalculated.

4. Player handles & content

Your public handle and any text you can set must not be offensive, hateful, deceptive, or infringe others' rights. We may change or reset handles that breach these Terms.

5. Intellectual property

The Game, its code, and its original content are owned by the operator or its licensors. Gem TD also uses third-party art and audio under their respective licenses — see the in-game credits for attributions. You may play the Game for personal, non-commercial enjoyment; you may not copy, resell, or redistribute the Game or its assets except as those licenses allow.

6. Virtual items

The Game may offer optional cosmetic items in the future. Any such items are licenses to use in-game content, have no monetary value, cannot be exchanged for real money, and are non-transferable. Purchase terms and your statutory withdrawal/refund rights as a consumer (including under Spanish and EU consumer law) will be presented at the point of purchase.

7. Disclaimers

The Game is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We do not guarantee that the Game will be uninterrupted, error-free, or that scores and data will never be lost. This does not affect any mandatory legal guarantees you have as a consumer.

8. Limitation of liability

To the fullest extent permitted by law, the operator will not be liable for any indirect or consequential loss, or for loss of data or progress, arising from your use of the Game. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so — including liability for death or personal injury caused by negligence, for fraud, or for any liability that cannot be limited under applicable mandatory law.

9. Termination

You may stop using the Game and request account deletion at any time. We may suspend or terminate access if you materially breach these Terms or where necessary to protect the Game and its players.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above; continued use after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of Spain. If you are a consumer, you also benefit from the mandatory protections of the law of your country of residence, and nothing in these Terms affects those rights; you may bring proceedings in the courts of your place of residence. Otherwise, disputes are subject to the competent courts of Spain.
